WAIVER, RELEASE AND INDEMNIFICATION

In consideration of the acceptance of my application and the permission to participate as an entrant or competitor in the SBR Muck Run 10K, SBR Muck Run 5K, SBR Junior Muck Run 1.5K Event(s) on September 12, 2009, and any other Mud Run related activities that take place before or after the event. I, hereby state I have conditioned myself to participate in the event(s) that I have chosen. I, for myself, my heirs, executors, administrators, successors, and assigns HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE Silver Birch Ranch Inc, Wolf River Township, and all other associations, sanctioning bodies and sponsoring companies, and elected and appointed officials, successors and assigns, OF AND FROM ALL claims, demands, damages, costs, expenses, actions and causes of action, whether in law or equity, in respect of death, injury, loss or damage to my person or property HOWSOEVER CAUSED, arising or to arise by reason of my participation in the said event, whether as spectator, participant, competitor, or otherwise, whether prior to, during or subsequent to the event, AND NOTWITHSTANDING that same may have been contributed to or occasioned by the negligence of the aforesaid. I FURTHER HEREBY UNDERTAKE TO HOLD AND SAFE HARMLESS AND AGREE TO INDEMNIFY all of the aforesaid from and against any and all liability incurred by any or all of them arising as a result of, or in any way connected with my participation in the said event. Further, I hereby agree to periodic mailings both electronic and physical from Silver Birch Ranch and official Muck Run Sponsors. Further I grant full permission to any and all of the foregoing to use any photography, video tapes, motion pictures, recordings or any other record of this event and my image for promotional purposes. Natural Disaster Policy If an Act of God/terrorism/Community Disaster occurs: • Muck Run Race directors will make decisions on altering the race course, postponing the race start time or canceling the race altogether. • Decisions will be made for racer safety. • The course is mainly on National Forest land and the US Forestry Service reserves the right to cancel a race if they feel the land will be permanently damaged by having hundreds of runners run on a course that has recently experienced a natural disaster (example: heavy rains). • Athletes in that race will have first right to sign up for that event the next year. • Financial: Silver Birch Ranch and the Muck Run staff cannot accept the risk of a disaster for everyone. Each athlete needs to accept the risk of his or her entry fee. There will be NO REFUNDS or free entries to other future races. Silver Birch Ranch is an equal opportunity provider.
